The same act had established a two-tier system of local government in Scotland consisting of regional and district councils, except for the islands councils, which were created as unitary local authorities. The Local Government etc (Scotland) Act 1994 abolished regional and district councils and transferred responsibility for community council schemes to new unitary councils created by the same act.

Highland

The Highland Council launched a review of community council arrangements on 21 September 2009, and this is intended to result in a new scheme covering the whole of the local authority area

The review includes three periods of public consultation and is to take more than a year to complete

At present, the local authority area should be covered by eight separate community council schemes, with each scheme covering the area of a former district of the Highland region

Scheme details published on the local authority's website, however, do not correspond with details of current arrangements published elsewhere on the same website, including an A-Z list linked to the current review

The total number of community areas in the schemes is 145, while the number in the A-Z list is 157, and there seems to be no good explanation for this difference

There are also differences which can be explained by legitimate name changes

It seems that the local authority is using new boundaries without having properly amended schemes, and has neglected to amend one scheme, for the area of the former district of Sutherland and dating from 1976, to take account of the transfer of part of the district of Caithness to the district of Sutherland

Therefore schemes now fail to cover the whole of the local authority area

Given that current arrangements to not correspond with scheme details, there must be some doubt as to whether bodies which the Highland Council represents as community councils are such within the meaning of the Local Government (Scotland) Act 1973
