Divorce

The details of Sir Paul's divorce from his ex-wife were the subject of controversy in 2008 when she brought a court case against him with respect to the marital alimony settlement. It was revealed that in 2001 she had agreed to the deduction of £14 million from the £29.6 million settlement of estate (of which her entitlement was 38 per cent), so Sir Paul could satisfy a "moral obligation" with respect to losses of a charity which had invested on a failed vending machine business on his recommendation. It emerged in court that, without her knowledge, Sir Paul used £600,000 of it to pay the charity's debt to the Inland Revenue and had kept the rest.

The Court of Appeal held that while his ex-wife was not entitled to the remaining £13.4 million, they felt "troubled" by his moral conduct. Lord Justice Collins stated in his judgement: "[h]e was presented to the court as a successful and eminent businessman...[b]ut I remain disturbed about the way in which he used the charity to fund his own enterprises while simultaneously taking advantage of gift aid, especially when coupled by the relativity with which he seemed to approach the concept of moral obligation." Collins noted that the facts fell short of what was required to re-open the marriage settlement case on grounds of fraud. Commenting on the outcome, Collins remarked that although succeeding, it was an "undeserved windfall" for Sir Paul.
