. He was later released on $500 bail. He has been charged with Second Degree Reckless Endangerment and is currently awaiting trial Desormeaux had essentially admitted to the incident, stating he was "trying to be cute." In the days after his arrest, he was pulled from at least two mounts at Saratoga.

On September 8, 2011, Desormeaux plead guilty to a reduced charge of Disorderly Conduct. He was ordered to pay a $2,000 fine and take a defensive driving course.
