In 2006, Moylan lost the primary election, but decided to run as a write-in candidate. On the same day, the United States Supreme Court announced that it would hear Moylan's challenge of Guam's bond issuance. The case was previously affirmed by the Supreme Court of Guam, but Moylan succeeded in convincing the Supreme Court the legality of Governor Felix Camacho's plan. Oral arguments in Moylan v. Camacho will likely take place in January 2007.
