When the Republicans lost the Majority in November 2008 he became the Deputy Minority Leader. Libous voted against same-sex marriage legislation on December 2, 2009; the bill was defeated.

His legislative accomplishments include consolidating two state agencies into the Office of Alcoholism and Substance Abuse Services, creating the state's Office of Traumatic Brain Injury, authoring the state's wheelchair lemon law, creating cancer maps that are available to the public so that they can see possible threats to their health and Timothy's Law

His current legislative priorities include State debt reform and making certain that the Dedicated Highway and Bridge Trust Fund is dedicated to repairing roads and bridges. Senator Libous is co-founder of YES! Safe Choices for Kids, an anti-drug abuse organization, BOOKS, which encourages kids to read and Buy from the Backyard, which encourages people to eat local farm products and shop at farmers' markets and stands.

He was also host to the Annual Steak Roast which attracted nearly 4,000 people from across the State and was the largest political fundraiser in Upstate New York from 1989 to 2008.

His wife is the Vice Chair of the New York State Workers' Compensation Board.
