 charges for refusing to divulge the passwords to San Francisco's FiberWAN system to his supervisors. After being arrested he was held on $5 million bail.
He is also accused of tampering with the network and subversively avoiding auditing checks.

He was found guilty of one count of felony network tampering on April 27, 2010 by a jury.

On July 30, 2010, Childs' attorneys filed motions requesting a new trial and for an arrested judgment. Both motions were denied and his final sentencing was rescheduled for August 6, 2010.

On August 6, 2010, Childs was sentenced to four years in the California State Prison by Judge Teri Jackson. Childs, as of August 6, had already served 755 days in prison, which will be applied to his sentence, leaving him eligible for parole in 4–6 months. He may also be required to foot California's bill for attempting to regain control of its network, which totals $900,000 USD. A hearing on financial penalties is scheduled to take place on August 13, 2010.
