Lindberg wanted to celebrate that evening's Super Bowl victory by the Dallas Cowboys, which he called "America's team," by finding "a Jap." Lindberg and an accomplice, 17-year-old Domenic Michael Christopher, encountered Ly, who was rollerblading around the tennis courts at Tustin High School. Lindberg and Christopher trapped Ly on the courts, beat him, kicked him and then stabbed him 22 times. Prosecutors categorized this act as a hate crime

In July 2008, the OC Weekly profiled Lindberg, Ly, the crime, and the pending case before the California Supreme Court, which was debating whether or not the killing was a hate crime after Lindberg's attorney filed an appeal.

On August 29, 2008, the California Supreme Court issued a 69-page decision that affirmed Lindberg's trial, convictions and death sentence.
