In this executive order, President Johnson justifies his measure, by claiming the following in the preamble of the order:

"It is the policy of the United States Government to provide equal opportunity in Federal employment and in employment by Federal contractors on the basis of merit and without discrimination because of race, color, religion, sex or national origin."

There is some wishful thinking in this sentence, because at the time the order was enacted, it was not the "policy of the United States Government to provide equal opportunity in Federal employment ...."

In the next paragraph, he says that Congress also follows this policy, because it enacted Title VII of the Civil Rights Act of 1964.

The president's former executive order no. 11246 pursues this goal as well, as is stated in the third paragraph of the preamble. However, it left out the feature sex and/or gender.

The fourth paragraph makes the following claim:

"It is desirable that the equal employment opportunity programs provided for in Executive Order No. 11246 expressly embrace discrimination on account of sex."

Therefore, President Johnson extended discrimination protection to the feature of sex.
